Using RealUptime
By creating an account or using RealUptime, you agree to these terms. You must be able to enter a binding agreement where you live. If you use RealUptime for a company, you confirm that you are allowed to accept these terms for that company.
The service
RealUptime checks endpoints you configure, receives error events your applications send, and presents the results through an operator dashboard, public status pages, and, on eligible plans, programmatic interfaces. Monitoring is evidence about what our probes observed; it is not a guarantee that a service is available to every user or from every network.
Your account and monitored targets
- Provide accurate account information and protect your login credentials and API keys.
- Only monitor systems you own or are authorized to test.
- Keep contact and billing information current when paid plans are available.
- Tell us promptly if you believe your account or credentials were compromised.
If a third party brings a claim against RealUptime because you monitored a system you were not authorized to monitor, or because of content you published through the service, you will defend RealUptime against that claim and cover the resulting costs and damages, to the extent permitted by law.
Acceptable use
You may not use RealUptime to:
- access, scan, disrupt, or overload systems without authorization;
- probe private networks, metadata services, or security controls;
- evade plan limits, rate limits, or other safeguards;
- publish unlawful, deceptive, abusive, or infringing content; or
- interfere with RealUptime or another customer's use of the service.
We may suspend activity that presents a security, legal, or reliability risk. When practical, we will explain the reason and provide a way to contact us.
Plans, billing, and cancellation
Current plan limits and prices are shown before checkout. Paid subscriptions renew for the billing period selected until canceled. You may cancel through the billing portal when billing is active; cancellation stops future renewals and normally takes effect at the end of the paid period. Contact support about an incorrect charge or refund request. Taxes may apply.
Refunds
You can request a full refund of your first payment on a plan within 14 days of that charge, for any reason. After that window, refunds are available only for a verifiable issue with the service, for example monitoring that did not run as configured or a dashboard feature that was broken for your account. On an annual plan, the 14-day no-questions refund covers up to one month-equivalent of the annual charge; the verifiable-issue path covers the full charge as before.
To request one, contact us through the support page. Within the 14-day window we will refund without asking you to reproduce anything. Outside that window we will try to reproduce the issue you describe. If we can reproduce it, we will refund the charge. If we cannot reproduce it, we will not issue a refund, and we will tell you what we found either way. A refund request only covers the most recent charge on your account, not earlier billing periods.
Your content and data
You keep ownership of the names, URLs, incident text, branding, and other content you provide. You give RealUptime permission to process and display that content only as needed to operate, secure, and support the service. Public status-page content is intentionally visible to anyone with its URL.
Where RealUptime processes personal data on your behalf and the GDPR, UK GDPR, or a similar law applies, our Data Processing Agreement forms part of these terms and is accepted by reference when you agree to them; no separate signature is needed.
Availability and changes
Features may change, and interruptions can happen. No service-level agreement applies unless we agree to one separately in writing. We may update these terms as the product changes; material updates will be posted here with a new effective date.
Termination and assignment
You can stop using the service and delete your account at any time from account settings. RealUptime may suspend or terminate an account for a material breach of these terms; when practical we will give notice and a chance to fix the problem first. On termination, your data is handled as the Data Processing Agreement and the Privacy Policy describe: you can export it beforehand, and it is deleted on the schedule stated there. You may not assign these terms without our consent, except to a successor in a merger or sale of your business; RealUptime may assign them to a successor of its business, and will post notice of any such change.
Disclaimers and responsibility
The service is provided on an “as is” and “as available” basis to the extent permitted by law, and RealUptime disclaims all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Do not use RealUptime as the only control protecting life, safety, money, or critical infrastructure. To the extent permitted by law, RealUptime is not responsible for indirect, incidental, special, consequential, or lost-profit damages arising from use of the service.
To the extent permitted by law, RealUptime's total aggregate liability arising out of or relating to the service is limited to the amounts you paid RealUptime for the service in the twelve months before the event giving rise to the claim, or 100 US dollars if you have not paid anything. This limit applies across all claims and legal theories and does not apply where the law does not allow it to.
Governing law and disputes
These terms are governed by the laws of the State of New Jersey, United States, excluding its conflict-of-law rules. Disputes arising out of these terms or the service will be resolved in the state or federal courts located in New Jersey, and both parties consent to that venue. One carve-out: matters governed by the Data Processing Agreement's Standard Contractual Clauses follow the governing-law and forum choices stated in those clauses.
If you are a consumer, meaning a natural person acting for purposes outside a trade, business, craft, or profession, resident in the European Union or the United Kingdom, nothing in this section takes away the mandatory consumer-protection rights the law of your country of residence gives you, including your right to rely on the mandatory provisions of that law notwithstanding a different choice of governing law (Regulation (EC) No 593/2008 on the law applicable to contractual obligations ("Rome I"), Art. 6), and, where it applies to this service, the 14-day right to withdraw from a distance contract without giving a reason (Directive 2011/83/EU on consumer rights, Art. 9). Our 14-day refund policy above is offered regardless of this right and does not replace it.
